{"id":3613,"date":"2010-03-23T09:43:11","date_gmt":"2009-12-10T07:18:59","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2009-12-10T07:18:59","slug":"en-US","status":"publish","type":"post","link":"http:\/\/fourthamendment.com\/?p=3613","title":{"rendered":"D.Neb.: Good faith exception applies to pre-<em>Gant<\/em> search"},"content":{"rendered":"<p>Defendant\u2019s search incident occurred nearly three years before <a href=\"http:\/\/www.supremecourtus.gov\/opinions\/08pdf\/07-542.pdf\">Gant<\/a>, and it was lawful at the time but not lawful under <a href=\"http:\/\/www.supremecourtus.gov\/opinions\/08pdf\/07-542.pdf\">Gant<\/a>. The court chooses to apply the good faith exception to a pre-<a href=\"http:\/\/www.supremecourtus.gov\/opinions\/08pdf\/07-542.pdf\">Gant<\/a> search incident attempting to forecast that the Eighth Circuit will follow the majority. United States v. Gray, 2009 U.S. Dist. LEXIS 113436 (D. Neb. December 7, 2009).<\/p>\n<p>There is an impeachment exception to Title III, the same as in the Fourth Amendment.  While this is a Title III case, it discusses the history of the impeachment rule under the Fourth Amendment, starting in 1954. United States v. Simels, 2009 U.S. Dist. LEXIS 113151 (E.D. N.Y. December 4, 2009).<\/p>\n<p>By statute, a Washington probation officer must have reasonable cause before a probation search can occur, and, under the Washington exclusionary rule, the inevitable discovery rule does not apply here. <a href=\"http:\/\/www.courts.wa.gov\/opinions\/pdf\/807558.opn.pdf\">State v. Winterstein<\/a>, 167 Wn. 2d 620, 220 P.3d 1226 (2009).<\/p>\n<p>Even with consent revoked, the government has plenty of probable cause in their investigation to get a search warrant, so the search was valid by inevitable discovery. United States v. Pickett, 2009 U.S. Dist. LEXIS 114234 (E.D. Mich.
