This was sufficient to show an unreasonable invasion of privacy and overcome qualified immunity. <a href=\"http:\/\/cdn.ca9.uscourts.gov\/datastore\/opinions\/2018\/09\/10\/16-16089.pdf\">Ioane v. Hodges<\/a>, 2018 U.S. App. LEXIS 25569 (9th Cir. Sep. 10, 2018).<\/p>\n<p>\u201cPetitioner has not identified any non-frivolous basis for seeking suppression of this evidence, so counsel cannot be deemed ineffective for failing to pursue that claim. Nothing in the record suggests that the actions of the law enforcement officers were so inconsistent with the Fourth Amendment that suppression would be required.\u201d Augustin v.
