Fairfax County Police Dept.<\/a>, 2018 Va. LEXIS 42 (Apr. 28, 2018):<br \/>\n<!--more--><\/p>\n<blockquote><p>The pictures and associated data stored in the Police Department&#8217;s ALPR database meet the statutory definition of &#8220;personal information.&#8221; Code \u00a7 2.2-3801. However, on the record before the Court, we are unable to determine whether the Police Department&#8217;s retention and &#8220;passive use&#8221; of information generated by ALPRs may be classified as an &#8220;information system&#8221; governed by the Data Act. Accordingly, the judgment of the circuit court granting summary judgment in favor of FCPD is reversed.
