A \u201csubpoena\u201d under the act includes subpoenas duces tecum. Moreover, even if HIPAA had been violated, there is no private right of action under HIPAA and thus no exclusionary remedy. <a href=\"http:\/\/www.pacourts.us\/assets\/opinions\/Superior\/out\/Opinion%20%20Affirmed%20%2010334781130464757.pdf?cb=1\">Commonwealth v. Williams<\/a>, 2017 PA Super 382, 2017 Pa. Super. LEXIS 997 (Dec. 8, 2017).<\/p>\n<p>2255 COA is denied. The Kansas courts resolved one Fourth Amendment claim on its merits, and that\u2019s entitled to AEDPA deference. The second claim is waived for failure to have brought it in the state courts because he had a \u201cfull and fair opportunity\u201d to litigate it (Stone v. Powell). <a href=\"http:\/\/www.ca10.uscourts.gov\/opinions\/17\/17-3151.pdf\">Walker v. Schnurr<\/a>, 2017 U.S. App. LEXIS 24709 (10th Cir. Dec. 7, 2017).*<\/p>\n<p>The taillight on defendant\u2019s car was out and that justified the stop.
