Miller<\/a>, 2017 U.S. App. LEXIS 14283 (9th Cir. Aug. 3, 2017).<\/p>\n<p>The government obtained a warrant on probable cause for tracking information on a telephone. The use of a USMJ rather than an Art. III judge was not seen as error, and, even if it was, the government didn\u2019t benefit from it and defendant wasn\u2019t prejudiced. Therefore, no suppression.
