Dudas<\/a>, 2008 Ohio 6983, 2008 Ohio App. LEXIS 5808 (11th Dist. December 31, 2008).<\/p>\n<p>Looking under the hood was within the scope of consent. There, reasonable suspicion or even probable cause had developed. Pincherli v. State, 295 Ga. App. 408, 671 S.E.2d 891 (2008).*<\/p>\n<p>Officer&#8217;s failure to disclose that defendant had a piece of paper in his mouth when he took a PBT was not material to the finding of probable cause, and the trial court&#8217;s finding of a <a href=\"http:\/\/caselaw.lp.findlaw.com\/scripts\/getcase.pl?court=us&amp;vol=438&amp;invol=154 \">Franks<\/a> violation was clearly erroneous. <a href=\"http:\/\/coa.courts.mi.gov\/documents\/OPINIONS\/FINAL\/COA\/20081223_C281202_35_281202.OPN.PDF\">People v.
