{"id":2647,"date":"2009-08-29T09:36:42","date_gmt":"2008-11-07T07:30:36","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2008-11-07T07:30:36","slug":"en-US","status":"publish","type":"post","link":"http:\/\/fourthamendment.com\/?p=2647","title":{"rendered":"ID: Defendant&#8217;s appearance and demeanor was RS"},"content":{"rendered":"<p>Officer had reasonable suspicion of drug use, in part from the defendant&#8217;s appearance and demeanor. <a href=\"http:\/\/www.isc.idaho.gov\/opinions\/grantham32657.pdf\">State v. Grantham<\/a>, 146 Idaho 804, 198 P.3d 128 (App. 2008)*:<\/p>\n<blockquote><p>They appeared disheveled and unkempt, had pock-marked skin, were gaunt or underweight, and had missing or rotted-out teeth, characteristics which cumulatively are evidence of extended methamphetamine use. &#8230; Wilkes was excessively nervous while speaking with Deputy Strangio, and unable to stop moving, which is also indicative of being under the influence of methamphetamine. Furthermore, Wilkes&#8217; demeanor changed visibly when asked whether there was methamphetamine in the car as compared to other drugs. While each of these reasons alone could appear innocent, all of Deputy Strangio&#8217;s observations considered together, and including his training and experience, give rise to reasonable suspicion sufficient to expand the scope of the traffic stop.<\/p><\/blockquote>\n<p>Defendant was stopped for speeding, and a warrant for her arrest was found. That supported a search incident of the car. <a href=\"http:\/\/www.courts.state.co.us\/Courts\/Supreme_Court\/opinions\/2008\/08SA186.pdf\">People v.
