Gambino-Zavala<\/a>, 539 F.3d 1221 (10th Cir. August 25, 2008).<\/p>\n<p>Search incident of cellphone failed because officers did not have probable cause (although they did have reasonable suspicion) for defendant&#8217;s arrest. <a href=\"http:\/\/www.ca5.uscourts.gov\/opinions\/pub\/07\/07-20200-CR0.wpd.pdf\">United States v.
