After a couple of weeks, the truck\u2019s movements were monitored daily. The issuance of the GPS warrant was without a finding of probable cause by the issuing judge, and the tracking had to be suppressed. GPS tracking is a \u201csearch.\u201d The lack of probable cause is also fatal to application of the good faith exception. <a href=\"http:\/\/mn.gov\/law-library-stat\/archive\/ctappub\/2016\/opa160618-101716.pdf\">State v. Liebl<\/a>, 2016 Minn. App. LEXIS 71 (Oct. 17, 2016).<\/p>\n<p>The affidavit for the search warrant in this case failed to show any nexus with any competent evidence. This failure was fatal, despite the officer&#8217;s good faith. The state supreme court has declined to recognize the good faith exception in a failure of probable cause, and that\u2019s what a failure of nexus is. <a href=\"https:\/\/appellate.nccourts.org\/opinions\/?c=2&#038;pdf=34667\">State v. Parson<\/a>, 2016 N.C.
