{"id":2281,"date":"2008-08-31T20:09:03","date_gmt":"2008-07-21T08:42:20","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2008-07-21T08:42:20","slug":"en-US","status":"publish","type":"post","link":"http:\/\/fourthamendment.com\/?p=2281","title":{"rendered":"NE: Field sobriety test must be based on reasonable suspicion"},"content":{"rendered":"<p>A traffic stop is probable cause for the stop, but reasonable suspicion of being under the influence is required for a field sobriety test. <a href=\"http:\/\/supremecourt.ne.gov\/opinions\/2008\/july\/jul18\/s07-834.pdf\">State v. Royer<\/a>, 276 Neb. 173, 753 N.W.2d 333 (2008):<\/p>\n<blockquote><p>[F]ield sobriety tests may be justified by a police officer&#8217;s reasonable suspicion based upon specific articulable facts that the driver is under the influence of alcohol or drugs. In determining the reasonableness of a search for purposes of the Fourth Amendment, the court balances the intrusion upon an individual&#8217;s privacy with the need to promote governmental interests. See <em>State v. McKinney<\/em>, 273 Neb. 346, 730 N.W.2d 74 (2007). <em>State v. McKinney<\/em>, supra, set out the balancing test for determining the reasonableness of a search, and other courts have applied a similar test to determine the reasonableness of a field sobriety test.<\/p><\/blockquote>\n<p>Defendant&#8217;s wearing a down jacket with a hole in it that could have concealed a gun when the jacket was inappropriate for the weather was a strong factor in reasonable suspicion. <a href=\"http:\/\/www.jud.state.ct.us\/external\/supapp\/Cases\/AROap\/AP109\/109ap393.pdf\">State v. DelValle<\/a>, 109 Conn.
