There was no showing that the officer even had to walk up to the gap to look. This case is virtually the same as <em>State v. James<\/em>, 980 So. 2d 769 (La. App. 4th Cir. March 12, 2008), of which the court quotes seven pages [so why not just say &#8220;this case is the same, affirmed; unpublished&#8221;?]. State v. Fournette, 989 So. 2d 199 (La. App. 4th Cir. 2008).*<\/p>\n<p>Bailing from a car during a pursuit and running away from it is an abandonment of the car. The court cites to a similar unpublished opinion. Watkins v. Commonwealth, 2008 Ky. App. LEXIS 213 (July 11, 2008):<\/p>\n<blockquote><p>While being pursued by a police officer, Watkins sought to evade police before coming to a sudden stop in a median between lanes of traffic. He immediately got out of the car and fled to a wooded area. As in <em>Blackford<\/em>, this evidence does not suggest Watkins intended to retain any privacy interest in the car. As such, Watkins could not establish that he retained a reasonable expectation of privacy in the automobile once he fled the scene.<\/p><\/blockquote>\n<p>(<em>Comment:<\/em> So, if the unpublished opinion is so unimportant, why is it unpublished?
