Assuming he had standing, it\u2019s clear that the owner had authority to consent and did consent to a search. Randolph doesn\u2019t require seeking out the defendant to get consent from him. Defendant twice consented to a search of his cell phone, so a warrant under Riley wasn\u2019t required. Defendant also challenged the state\u2019s acquiring CSLI without a warrant under the predecessor section to Article 18.21 \u00a7 5(a), but the court concludes that the Texas Court of Criminal Appeals would not find the state constitution broader than the Fourth Amendment on this issue, and that court just denied relief on the Fourth Amendment in <a href=\"http:\/\/www.search.txcourts.gov\/SearchMedia.aspx?MediaVersionID=1aabe1dc-deaf-4095-a0fa-a2a353f41c8f&#038;coa=coscca&#038;DT=OPINION&#038;MediaID=6fff0200-81a4-4b9c-8373-d29978571fb1\">Ford v.
