Mena<\/em> does not permit a law enforcement officer to extend a stop to ask questions of a passenger"},"content":{"rendered":"<p><a href=\"http:\/\/caselaw.lp.findlaw.com\/scripts\/getcase.pl?court=us&amp;vol=544&amp;invol=93\"><em>Muehler v. Mena<\/em><\/a> does not permit a law enforcement officer to extend a stop to ask questions of a passenger. That case is limited to search warrants. <a href=\"http:\/\/www.kscourts.org\/Cases-and-Opinions\/opinions\/supct\/2008\/20080530\/96189.htm\">State v. Smith<\/a>, 286 Kan. 402, 184 P.3d 890 (2008):<\/p>\n<blockquote><p>In <a href=\"http:\/\/caselaw.lp.findlaw.com\/scripts\/getcase.pl?court=us&amp;vol=544&amp;invol=93\"><em>Muehler v. Mena<\/em><\/a>, 544 U.S. 93, 161 L. Ed. 2d 299, 125 S. Ct. 1465 (2005), the United States Supreme Court held that law enforcement officers could ask questions unrelated to the purpose of a search when executing a warrant authorizing the search of a residence.
