The opinion below is <a href=\"http:\/\/www.supreme.state.az.us\/opin\/pdf2007\/CR060385PR.pdf\">here<\/a>.<\/p>\n<p>The question presented from the cert petition:<\/p>\n<blockquote><p>In <a href=\"http:\/\/caselaw.lp.findlaw.com\/scripts\/getcase.pl?court=us&amp;vol=453&amp;invol=454\"><em>New York v. Belton<\/em><\/a>, 453 U.S. 454 (1981), this Court held that the risks to officer safety and to the preservation of evidence inherent in the arrest of a vehicle\u2019s recent occupant justify a contemporaneous warrantless search of the automobile\u2019s passenger compartment incident to the arrest.
