Defendant&#8217;s <a href=\"http:\/\/caselaw.lp.findlaw.com\/scripts\/getcase.pl?court=us&amp;vol=438&amp;invol=154\"><em>Franks<\/em><\/a> challenge fails: &#8220;The Abdallahs have not made a substantial showing that allegations in the supporting affidavit were deliberate falsehoods or made with a reckless disregard for the truth.&#8221; The good faith exception also applies.  Medicaid fraud &#8220;all records&#8221; warrant was valid because of the nature of the claimed crime.  <a href=\"https:\/\/ecf.txsd.uscourts.gov\/cgi-bin\/login.pl?591110065444725-L_835_0-1\">United States v. Abdallah<\/a>, 2007 U.S. Dist. LEXIS 90196 (S.D. Tex. December 7, 2007).*<\/p>\n<p>Observations from a citizen informant and an off-duty officer were sufficient to show reasonable suspicion. <a href=\"http:\/\/www.tsc.state.tn.us\/OPINIONS\/tcca\/PDF\/074\/HaynieJustinBradleyOPN.pdf\">State v. Haynie<\/a>, 2007 Tenn. Crim. App. LEXIS 931 (December 7, 2007):<\/p>\n<blockquote><p>Consequently, we conclude that Investigator Land acted with reasonable suspicion supported by specific and articulable facts supplied by his dispatcher, a known citizen informant, and an off-duty law enforcement officer that at least one of the occupants of the suspect vehicle was engaged in illegal activity when he activated his cruiser&#8217;s blue lights and stopped Defendant Ouzts&#8217;s vehicle. The Defendants do not challenge the validity of Defendant Ouzts&#8217;s consent to the ensuing search.
