{"id":1338,"date":"2008-09-20T21:10:31","date_gmt":"2007-09-10T07:55:37","guid":{"rendered":""},"modified":"-0001-11-30T00:00:00","modified_gmt":"2007-09-10T07:55:37","slug":"en-US","status":"publish","type":"post","link":"http:\/\/fourthamendment.com\/?p=1338","title":{"rendered":"OK: Exigent circumstances are no longer required for an automobile search"},"content":{"rendered":"<p>Oklahoma determines that separate exigent circumstances are no longer required for a search under the automobile exception under the state constitution, and it follows <a href=\"http:\/\/caselaw.lp.findlaw.com\/scripts\/getcase.pl?court=us&amp;vol=456&amp;invol=798\"><em>Ross<\/em><\/a> and <a href=\"http:\/\/caselaw.lp.findlaw.com\/scripts\/getcase.pl?court=us&amp;vol=383&amp;invol=106\"><em>Dyson<\/em><\/a>. <a href=\"http:\/\/www.oscn.net\/applications\/oscn\/DeliverDocument.asp?CiteID=450929\">Gomez v. State<\/a>, 2007 OK CR 33, 168 P.3d 1139 (2007):<\/p>\n<blockquote><p>[*P16]  Because we believe the United States Supreme Court&#8217;s decisions in <em>Ross<\/em> and <em>Dyson<\/em> rest on sound principles, we are persuaded they should inform our construction of Article 2, \u00a7 30. We therefore hold that a warrantless search of a vehicle is not unreasonable under Article 2, \u00a7 30, of the Oklahoma Constitution in the absence of a showing of exigent circumstances when police have probable cause to believe that evidence of a crime is present. To the extent that Davis, Whitehead, and Lawson hold to the contrary, they are overruled.<\/p><\/blockquote>\n<p>There was probable cause on the totality, considering the deference that search warrants get, and the trial court erred in suppressing. <a href=\"http:\/\/www.aoc.state.nc.us\/www\/public\/coa\/opinions\/2007\/061415-1.htm\">State v. Edwards<\/a>, 185 N.C. App. 701, 649 S.E.2d 646 (2007).*<\/p>\n<p>Defendant&#8217;s employer could consent to search of work computers for child porn. United States v. Bassignani, 2007 U.S. Dist.
