Inside the residence they could smell marijuana. One room of the residence defendant\u2019s wife wouldn\u2019t consent to further search, so they properly froze the premises to get a search warrant. Drugs were found and admissible. State v. Allah, 2014 N.C. App. LEXIS 968 (September 2, 2014).<\/p>\n<p>Defendant was a suspect in a sexual assault, and he was arrested at home. The officers offered to let him smoke a cigarette before they took him away, just so they could get DNA from the butt. He smoked and the officer offered to dispose of the butt and defendant handed it to him. It was thus abandoned. State v. Borders, 2014 N.C.
