{"id":11631,"date":"2014-05-20T13:19:45","date_gmt":"2014-05-20T18:19:45","guid":{"rendered":"http:\/\/fourthamendment.com\/?p=11631"},"modified":"2014-05-20T13:19:45","modified_gmt":"2014-05-20T18:19:45","slug":"cincinnati-com-pants-full-of-candy-erupts-into-legal-battle-sw-for-pds-office","status":"publish","type":"post","link":"http:\/\/fourthamendment.com\/?p=11631","title":{"rendered":"Cincinnati.com: Pants full of candy erupts into legal battle; SW for PD&#8217;s office"},"content":{"rendered":"<p>Cincinnati.com: <a href=\"http:\/\/www.cincinnati.com\/story\/news\/courts\/2014\/05\/18\/pants-full-candy-erupts-legal-battle\/9266509\/\">Pants full of candy erupts into legal battle<\/a> by Kimball Perry:<\/p>\n<blockquote><p>A Hamilton County theft case involving a man who stuffed $200 worth of candy in his pants erupted into a heated legal battle that has left defense attorneys still simmering.<\/p>\n<p>On one side are defense attorneys, including the Public Defenders office, who insist Cincinnati Prosecutor Charlie Rubenstein improperly won a warrant to search the Public Defenders office for evidence in the case involving candy thief Terrance Jones, 43.<\/p>\n<p>&#8220;We&#8217;re being punished for doing our work,&#8221; Public Defender Ray Faller said.<\/p>\n<p>On the other is Rubenstein, who insists Scott Nazzarine, the public defense attorney representing Jones, improperly withheld evidence, forcing Rubenstein to get the search warrant.<\/p>\n<p>&#8220;You can&#8217;t take evidence and hide it,&#8221; Rubenstein said. His office prosecutes misdemeanors in Cincinnati.<\/p><\/blockquote>\n<p>Why not just seek a court order?
