This is hardly news. I did a Google search, and, according to CNET, this was reported by them in November 2006. SWAT Teams have been wearing them for years to record their entries.

This should not be surprising. When the UK first started it a year ago as reported here and here, the cost was fairly significant, at least there. There is even a post of a motorcyclist who had one eluding the police. Here, we’ve seen sporting events for years where participants wore cameras. Google “helmet cams” or add “police” to the search, and you’ll see the number of suppliers of these cameras. One touts supplying NASA so the Space Shuttle crew’s work could be monitored by Ground Control.

It is no longer news. The question for criminal lawyers is whether these digital images are turned over in discovery. A related question is whether the police even tell the prosecutor. The video would show activities and statements of the defendant and would be discoverable as a matter of course.

Also, surveillance equipment does not require that the camera even be obvious; it can be a small, unobstrusive or nearly invisible camera on the body.

b2evALnk.b2WPAutP Continue reading →

["post-1143","post","type-post","status-publish","format-standard","hentry
["GET
