{"id":11295,"date":"2014-04-27T17:28:22","date_gmt":"2014-04-27T22:28:22","guid":{"rendered":"http:\/\/fourthamendment.com\/?p=11295"},"modified":"2014-04-30T05:48:17","modified_gmt":"2014-04-30T10:48:17","slug":"reuters-u-s-judge-rules-search-warrants-extend-to-overseas-email-accounts","status":"publish","type":"post","link":"http:\/\/fourthamendment.com\/?p=11295","title":{"rendered":"Reuters: U.S. judge rules search warrants extend to overseas email accounts &#8212; Updated with link"},"content":{"rendered":"<p>Reuters via CNBC: <a href=\"http:\/\/www.cnbc.com\/id\/101615941\">U.S. judge rules search warrants extend to overseas email accounts<\/a> by Joseph Ax:<\/p>\n<blockquote><p>NEW YORK, April 25 (Reuters) &#8211; Internet service providers must turn over customer emails and other digital content sought by U.S. government search warrants even when the information is stored overseas, a federal judge ruled on Friday.<\/p>\n<p>In what appears to be the first court decision addressing the issue, U.S. Magistrate Judge James Francis in New York said Internet service providers such as Microsoft Corp or Google Inc cannot refuse to turn over customer information and emails stored in other countries when issued a valid search warrant from U.S. law enforcement agencies.<\/p>\n<p>If U.S. agencies were required to coordinate efforts with foreign governments to secure such information, Francis said, &#8220;the burden on the government would be substantial, and law enforcement efforts would be seriously impeded.&#8221;<\/p><\/blockquote>\n<p>Microsoft&#8217;s comment on TechNet Blog: <a href=\"http:\/\/blogs.technet.com\/b\/microsoft_on_the_issues\/archive\/2014\/04\/25\/one-step-on-the-path-to-challenging-search-warrant-jurisdiction.aspx\">One step on the path to challenging search warrant jurisdiction<\/a> by David Howard, Corporate Vice President &#038; Deputy General Counsel, Microsoft:<\/p>\n<blockquote><p>The U.S. government doesn\u2019t have the power to search a home in another country, nor should it have the power to search the content of email stored overseas.<\/p>\n<p>To protect this principle, we filed a formal legal challenge months ago to a U.S. search warrant seeking customer email content that is located exclusively outside the United States.
