The trial court did not err in suppressing. <a href=\"http:\/\/www.sconet.state.oh.us\/rod\/docs\/pdf\/8\/2014\/2014-ohio-496.pdf\">State v. Jones<\/a>, 2014-Ohio-496, 2014 Ohio App. LEXIS 483 (8th Dist. February 13, 2014).*<\/p>\n<p>Defense counsel was not ineffective in this child pornography case for not filing a motion to suppress where the same issue was pending when the case was being prosecuted in state court and defendant lost. Then the case went federal. He could not win on the merits of the search claim. Moreover, not pursuing the search issue was part of an agreed strategy to get the lowest possible sentence.
